Terms of Service – SOKU

§1. General provisions

  1. These Terms of Service govern the use of the SOKU website (hereinafter: "Service"), available at https://soku.pro.
  2. The owner and operator of the Service is Michał Soczyński, conducting business under the name Michał Soczyński Smash The Code, ul. Kozłowskiego 33/10, 62-064 Plewiska, Poland, VAT ID: PL5732775252, email: support@soku.pro (hereinafter: "Service Provider").
  3. The Service is a SaaS (Software as a Service) platform enabling analysis of YouTube channels using artificial intelligence.
  4. Using the Service constitutes acceptance of these Terms of Service, the Privacy Policy and the YouTube Terms of Service.
  5. SOKU is not affiliated with or sponsored by YouTube LLC or Google LLC. YouTube™ and Google™ are registered trademarks of Google LLC.

§2. Definitions

  1. User – a natural person, legal entity or organisational unit without legal personality who uses the Service.
  2. Account – an individual User account in the Service, created through Google OAuth 2.0 authentication.
  3. Service – electronic services provided by the Service Provider through the platform.
  4. Plan – the subscription option selected by the User (FREE, PRO Monthly or PRO Yearly), as described in §6.
  5. Closed Beta – a phase of Service development in which access is limited to selected Users with the Service Provider's consent.
  6. One-time Pack – a one-time credit purchase (Starter Pack or Booster Pack), not renewed automatically, as described in §6.

§3. Technical requirements

  1. Using the Service requires:
    • a device with Internet access,
    • a current version of a web browser (Chrome, Firefox, Safari, Edge),
    • an active Google account (required for login and connecting a YouTube channel),
    • cookies and JavaScript enabled.
  2. The Service Provider is not liable for technical problems resulting from failure to meet the above requirements.

§4. Registration and Account

  1. Registration in the Service takes place exclusively through Google account login (Google OAuth 2.0).
  2. During the Closed Beta phase, registration is only available to Users whose email address has been previously added to the permitted list by the Service Provider.
  3. By registering, the User declares that they:
    • have read the Terms of Service and accept their provisions,
    • have read the Privacy Policy,
    • have provided accurate and up-to-date data,
    • are authorised to use the YouTube channel they connect to the Service.
  4. The User is responsible for the security of their Google account through which they access the Service.

§5. Scope of Services

  1. The Service enables:
    • YouTube channel analytics,
    • competitor channel tracking,
    • outlier and viral analysis,
    • detailed video analysis,
    • creating channel and video playlists,
    • and other features described in the Plan descriptions.
  2. The Service uses artificial intelligence tools provided by third parties. Specific models may change.
  3. The Service Provider notes that AI-generated results are advisory in nature and do not constitute professional advice. The User is responsible for decisions made on their basis.
  4. The Service Provider reserves the right to modify the scope of Services, including adding new features and modifying existing ones.

§6. Plans and payments

  1. The Service is available in the following options:
    • FREE – free of charge, 250 credits upon registration,
    • PRO Monthly – $27 net per month, 2,700 credits per month,
    • PRO Yearly – $267 net per year, 32,400 credits per year,
    • Starter Pack (one-time) – $17 net, 1,000 credits valid for 12 months,
    • Booster Pack (one-time) – $17 net, 1,700 credits valid for 12 months, requires an active PRO subscription.
  2. All prices are quoted in US dollars (USD) and are net of tax. Applicable taxes may be added at checkout depending on the User's location.
  3. Payments are processed by Creem (creem.io). Subscription payments are collected in advance: monthly plans are billed each month, annual plans are billed once a year. One-time packs are charged at the time of purchase.
  4. Upgrading from a monthly to an annual subscription is available at any time. Downgrading from an annual to a monthly subscription during an active billing period is not available.

  6. The Service Provider reserves the right to change Plan prices, notifying Users at least 30 days in advance by electronic means.

§7. Cancellation and termination

  1. The User may cancel their subscription at any time.
  2. After cancellation, the User retains access to the Plan until the end of the paid billing period.
  3. The User may delete their Account by contacting the Service Provider at support@soku.pro.
  4. The Service Provider reserves the right to suspend or delete a User's Account in the event of a breach of the Terms of Service.
  5. A consumer has the right to withdraw from the contract within 14 days of concluding it. Before each purchase (subscription or credit pack), the User is asked to give express consent to the immediate performance of the digital service and to acknowledge that the right of withdrawal is lost upon commencement of delivery, in accordance with Art. 38(13) of the Polish Act of 30 May 2014 on Consumer Rights.

§8. User rights and obligations

  1. The User undertakes to:
    • use the Service in accordance with its purpose and applicable law,
    • not take actions that could disrupt the operation of the Service,
    • not share their Account with third parties,
    • not use automatic data scraping techniques on the Service,
    • not reverse engineer, decompile or disassemble the Service source code.
  2. The User bears sole responsibility for how they use the content and data obtained through the Service.

§9. Intellectual property

  1. The Service, its source code, graphical interface, logo, name and all content presented in the Service are the property of the Service Provider and are protected by copyright.
  2. AI-generated content created at the User's request (descriptions, scripts, articles) may be used by the User within the scope of using the Service, with the reservation that the Service Provider does not transfer copyright in AI tools to the User.
  3. Copying, distributing and modifying elements of the Service without the written consent of the Service Provider is prohibited.
  4. By using the Service, the User declares that they hold all necessary rights to the content transmitted from their channel to external AI services (including video titles, descriptions, subtitles and metadata) and consents to its processing by those services to the extent required to perform the requested functionality.

§10. Liability

  1. The Service Provider makes every effort to ensure the Service operates correctly and without interruption, but does not guarantee uninterrupted availability.
  2. The Service Provider is not liable for:
    • interruptions to the Service caused by factors beyond the Service Provider's control (server failures, Internet outages, YouTube API changes),
    • content generated by third-party AI tools,
    • business decisions made by the User based on Service data,
    • data loss resulting from User actions or force majeure,
    • changes to the YouTube or Google API that may affect Service functionality.
  3. The Service Provider's liability to the User is limited to the amount paid by the User in the 3 months preceding the event.

§11. Complaints

  1. Complaints regarding the operation of the Service should be submitted to support@soku.pro.
  2. A complaint should include: User contact details, a description of the problem and the expected resolution.
  3. The Service Provider will process the complaint within 30 days of receipt and inform the User of the outcome by electronic means.

§12. Personal data

  1. The Service Provider is the controller of Users' personal data.
  2. The rules for processing personal data are set out in the Privacy Policy.
  3. The Service processes data from the YouTube API in accordance with the YouTube API Services Terms of Service. Additional information about how Google processes personal data is set out in the privacy documentation published by Google as a service provider.

§13. Final provisions

  1. The Service Provider reserves the right to amend these Terms of Service. Users will be notified of changes by electronic means at least 30 days in advance.
  2. If a User does not accept the amended Terms of Service, they have the right to terminate the Service before the changes come into effect.
  3. Matters not covered by these Terms of Service are governed by Polish law, in particular:
    • the Civil Code,
    • the Act of 18 July 2002 on the Provision of Electronic Services,
    • the Act of 30 May 2014 on Consumer Rights,
    • Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
  4. Any disputes arising from use of the Service will be resolved by the court with jurisdiction over the Service Provider's registered office, subject to the provisions on jurisdiction in consumer matters.
  5. Consumers have access to out-of-court complaint resolution methods.
  6. These Terms of Service enter into force on 10 May 2026.
